This Contract is between you and JMJImages.co.uk (sometimes referred to as US, OUR, WE, OURS). By downloading IMAGES from this website, you agree to be bound by the terms of this contract with respect to all IMAGES.

This is a LICENSE, NOT a sale. You are permitted to use the downloaded IMAGES. We continue to own the intellectual property rights of the IMAGES.

Third parties who wish to use any IMAGES MUST download the IMAGES from the JMJImages.co.uk website themselves.

This Contract allows you the use of JMJImages IMAGES (namely, the photographic images, illustrations, or other material that you download from the JMJImages.co.uk website ) with this JMJIMAGES LICENSE CONTRACT

You are hereby granted a perpetual, non-exclusive, non-transferable license to use the IMAGES on the terms and conditions contained in this JMJIMAGES LICENSE CONTRACT. You may only engage in expressly permitted activity with any IMAGES downloaded. All other rights in and to the IMAGES and accompanying materials, including all intellectual property rights relating thereto, are retained by JMJImages.co.uk.

All IMAGES are provided in two (2) sizes :

Web quality: 1600 pixels on the longest side @ 72 dpi
Print quality: 4961 pixels on the longest side @ 300 dpi

ALLOWED USES:

You may:

• use WEB or PRINT IMAGES for personal use only;
• physically transfer any IMAGES from one location to another, provided that it is only for personal use;
• keep a single copy of IMAGES solely for back-up purposes (you must reproduce all proprietary notices on thissingle back-up copy);
• use the IMAGES for advertising and promotional printed materials;
• use the IMAGES for personal online or electronic publications only, including web pages to a maximum of1600 pixels @ 72 dpi on the longest side.

PROHIBITED USES:

You may NOT:

• provide a copy of the IMAGES downloaded from JMJImages.co.uk, or any portions thereof, to anyone else, or allow anyone to gain access to the IMAGES, or any portion thereof, except as permitted above. You may not do anything with these IMAGES that is not expressly permitted;
• use any IMAGES in design template applications for multiple sale;
• display any IMAGES on websites designed for sales of ‘print on demand’ products, including postcards, mugs, t-shirts, posters and other items without prior permission from JMJImages;
• use the IMAGES in any posters or other items for multiple sale;
• use the IMAGES or any part thereof as part of a trade-mark, design-mark, trade-name, business name, service mark, or logo;
• incorporate the IMAGES in any product that results in a redistribution of the IMAGES;
• use the IMAGES in a fashion that may be considered to be pornographic, obscene, defamatory or libelous in nature;
• use any IMAGES in other images that depicts a person to endorse a business, product or service;
• use any IMAGES in other images that depicts a person in a potentially sensitive subject matter;
• remove any notice of copyright, trade-mark or other proprietary right from any place where it appears in the IMAGES or its accompanying materials;
• sub-license, sell, rent, lend, or otherwise distribute any IMAGES purchased from JMJImages;
• post a copy of any IMAGES on a network server or web server for use by other users or transfer the rights to any IMAGES or accompanying materials, except as specifically provided for in this Contract;
• use the IMAGES for editorial purposes without including the following credit adjacent to the IMAGES: ©JMJImages [ PHOTOGRAPHERS NAME ];
• use any IMAGES of human models that have been edited, used and/or displayed with:
  • texts insinuating the model makes a statement or is saying something;
  • a name edited into the image supposedly to be identifying the model;
  • applications using the image as an avatar or as an interactive virtual person;
  • an image or as an image labelled with the name of someone else, pretending the model is someone else

TERMS:
This Contract is effective until terminated. You can terminate this Contract at anytime by destroying the IMAGES, and any related  Works, and any copies of it or accompanying materials, and by ceasing to use the IMAGES, and any Derivative Works related to the IMAGES. This Contract will also terminate upon your failure to comply with the terms of this written contract.You agree, upon termination of this Contract, to destroy all copies of any IMAGES, and any related Derivative Works, to cease using the IMAGES, and any related Derivative Works, and to confirm to JMJImages in writing that you have complied with these conditions.

Termination of this Contract DOES NOT relieve you of your responsibilities to pay any monies due to JMJImages or your obligations not to use the IMAGES, or any related Derivative Works, other than as permitted under this Contract.

REPRESENTATIONS AND WARRANTIES:

The JMJImages.co.uk website acts as an exchange of IMAGES between US (JMJImages ) and those who wish to use such IMAGES. Accordingly, JMJImages.co.uk makes no representation or warranty that any IMAGES provided are royalty free.

BY DOWNLOADING THE IMAGES YOU ACKNOWLEDGE THAT YOU HAVE READ THIS CONTRACT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE CONTRACT BETWEEN YOU AND JMJImages, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR CONTRACT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN YOU AND JMJImages RELATING TO THE SUBJECT OF THIS CONTRACT.
